This Seminar will focus on new legislation in 3 areas;

1. Employment Relations (Flexible Working) Act 2023

1.1. Coming into force on 6th April 2024 the new Act creates new requirements for employers to consult with the employee before rejecting their flexible working request, permission to make two statutory requests in any 12-month period (rather than the current one request), reduced waiting times for decisions to be made (within which an employer administers the statutory request) from three months to two months and the removal of existing requirements that the employee must explain what effect, if any, the change applied for would have on the employer and how that effect might be dealt with.

1.2. The Seminar will consider how to respond to flexible working requests and more broadly how to balance flexible working requests with the business needs under the new statutory framework.

2. Carer’s Leave Regulations 2024

2.1. Coming into force on 6th April 2024 the new Act grants carers a right to a week’s leave for caring responsibilities

3. Worker Protection (Amendment of Equality Act 2010) Act 2023

3.1. Coming into force 26th October 2024, the new Act places an additional duty on employers to take reasonable steps to prevent sexual harassment of employees. Whilst the Act has been watered down from it’s original draft, which sought to make employers liable for the acts of third parties, the new Act shifts the focus from redress to one of prevention of sexual harassment. Employers need clear policies, training, and proper, impartial investigations into reported harassment. The Equalities and Human Rights Commission will be able to take enforcement action against firms that breach this duty, and employers will also be liable to individuals as part of wider sexual harassment claims at an employment tribunal.
